High Ticket Hero Terms and Conditions

THIS SERVES AS YOUR CONTRACT FOR THIS PROGRAM. PLEASE READ THROUGH THIS CAREFULLY.

This agreement covers your participation in High Ticket Hero with Backbone Business.

Services.

The Services consist of the following components:

9 live 90 min-content and group coaching calls

Weekly live 60 min 'Pomodoro Power Hour' work calls

1 Offer Clarity Checkpoint session: get feedback from your coach on your offer, Aligned

Program Promise, and target client based on your business goals and skillset. This is a

mandatory session.

Access to a group text and voice chat on Slack

Access to our Resource hub

Support from the Backbone Business team

Any bonuses, if applicable

Fee and Payment.

If you have not chosen to pay in full, your payments shall be made via automatic transfer. The Client acknowledges that an agreement regarding monthly credit card charges immediately follows this contract. The client will be automatically charged by credit card per the schedule listed above. If the charge does not go through, you will receive notification of a failed payment. You have 3 business days to update your payment information.

There will be a late payment fee of 18% for payments received by Backbone Creative after the three day window, and the late payment fee will be added to the next installment due.

Payments are not refundable for any reason. All payments are due regardless of whether or not you fully and faithfully participate. Furthermore, you agree that you are responsible for full payment of fees for the entire program, regardless of whether you actually attend or complete the program, and regardless of whether you have selected a lump sum or monthly payment plan.

Term & Termination.

The term of this Agreement is three (3) months beginning on the day this Agreement is executed. The Client is responsible for all installments of the Fee due. Should you fail to remit any of the required payments on time, and have not corrected the situation in a prompt manner, Backbone Business may terminate further services, and you will still be responsible for the remaining balance of the program.

Backbone Creative is entitled to terminate this Agreement and the Client’s participation for any reason, including failure to pay any installment of the fee within thirty days of its due date. More specifically, we may also terminate services if, in our sole opinion, you are conducting yourself or your business in a manner which is disparaging or disruptive to the Company or infringes upon the Company or violates the confidentiality covenant stated above. In no event will any refunds be issued.

Relationship.

The nature of coaching is intimate. Clients occasionally bring up issues that may be better served by another type of professional (i.e. a consultant, therapist, accountant, etc.). If that occurs, your Coach will advise you and offer a referral or assistance, if possible. You clearly understand that your coaching stays within the scope of a Professional Co-Active Coach (PCC). While coaching at times can be therapeutic, your Coach is not a trained or licensed therapist and has no intent to practice therapy with you.

Confidentiality and Nondisclosure.

You acknowledge and understand that the methods, processes and strategies taught in the Circle and all materials provided to you constitutes our Proprietary System which is confidential. You agree to maintain the absolute confidence of this program and our Proprietary System and agree not to duplicate, disseminate, distribute or otherwise disclose any part to any 3rd parties, for any reason, unless it is part of the Program or unless required by legal process. If you use our intellectual property, we will find and we will take legal action.

The Company considers Client’s future plans, business affairs, customer lists, personal information, goals and financial information to be Client’s proprietary information. And therefore the Company promises that all information provided will be kept strictly confidential, as much as possible within the context of a group program. Neither the Company nor the Coach will share Client's information, including and especially content of coaching calls and contact information, with others (other clients as well as business and personal contacts outside of the Company) without express written approval from Client.

Recordings of Sessions.

You acknowledge, agree and authorize that all coaching sessions will be recorded by the Company, and that you will receive access to all recordings on our digital platform.

You agree not to use the recordings for any purpose other than your personal enrichment, and for further coaching facilitation with the Company. You will not duplicate the recordings for any reason without Company’s permission, nor disclose to any 3rd party, nor post any part of such recordings on any social media or online, internet site, or otherwise reveal the contents through any medium, without the Company’s express written permission. The Company will not post, duplicate or sell any recording to anyone. You agree to hold us harmless from any unauthorized disclosure of a group recording by another group member, and to indemnify us (and any other group members) damages for your unauthorized disclosure.

Acknowledgement and Responsibility.

The Services that are provided pursuant to this Agreement, whether provided by your Coach, any other representative of Backbone Business or any visiting coach, are to assist you in achieving your personal and business goals. You acknowledge and agree that neither Backbone Business, your Coach nor any visiting coach can guarantee any particular results as you pursue your goals, and that neither Backbone Business, your Coach nor any visiting coach will have any responsibility or liability to you based upon your use of any of the advice and services provided pursuant to this Agreement.

This contract represents a commitment to you. This is a commitment that requires you to show up for yourself—both practically, to phone calls, and mentally, to challenges—and one that requires both of us to win. Your coach will count on you to ‘play’ and participate so you can move forward.

Backbone is committed to diversity, equity, and inclusion. Our programs are space for anti-racist conversations alongside business and personal commitments. We hold one another to having these tough conversations when they arise, and have the expectation that racism, sexism, transphobia, fatphobia, ableism, and bigotry are not tolerated.

Backbone Business’ hours are 9:30am—4pm PST. Backbone Business endeavors to reply to client inquiries and needs, including on Slack, within 24 hours.

General.

Backbone Business is the owner, and has the exclusive right to use, all copyrights, trade secrets and other intellectual property, used in connection with coaching. The Client acknowledges that access to recordings of private coaching calls will be made available in a timely manner monthly. Backbone Business does not share access to these recordings with persons outside the organization.

The Client cannot assign any rights or benefits under this Agreement to any other person without Backbone Business’s prior written consent.

This Agreement is governed by and construed in accordance with the internal laws of the State of California.
